Admission CriteriaThe defendant must have the desire to participate fully in the Jackson County Drug Court program. Moreover, the defendant must possess the desire to begin his or her recovery from his or her drug(s) of choice. To be considered as a candidate for Jackson County Drug Court the defendant must voluntarily agree to plead guilty to his or her criminal charges. 1. Offenders charged with possession of drugs eligible under § 12-23-5, Code of Alabama, (See attached Deferred Prosecution Eligibility Guidelines). 2. Offenders charged with property offenses where addiction is noted, and where the victim agrees to allow defendant in drug court. 3. The defendant must have a verifiable address. 4. Should the defendant be on probation, he or she must have the permission of the judge who presides over the probation case to participate in the Jackson County Drug Court program. 5. Offender must have a substance abuse diagnosis. The assessment criteria is specifically based upon the DSM-IV criteria and the assessment must be completed by a clinician certified by DMH/MR. 6. The defendant must be able to overcome lack of transportation issues, childcare issues, and other issues, which may interfere with his or her full participation in the Jackson County Drug Court program. 7. The District Attorney, the Court Referral officer, the arresting officer and the treatment provider are all given a voice in the admission of all drug court clients to the judge.
